Exciting New Consultations on Data Access and Fee Structures Unveiled

HM Land Registry Initiates Consultations for Fee Transparency

HM Land Registry is embarking on two consultations aimed at enhancing the clarity and simplicity of its fee structure for customers, whilst also facilitating easier access to essential information. The current registration fees, primarily determined by property value, often pose challenges in accurate assessment, leading to requisitions and subsequent delays. In response, HM Land Registry is proposing a more streamlined approach for Scale Two fees, which pertain to transactions where no money exchanges hands or when properties are registered at below market value, alongside mortgages. Stakeholders are invited to provide feedback on this new framework.

Enhancing Data Accessibility for Public Sector

In parallel with the fee restructuring consultation, HM Land Registry is seeking opinions on measures designed to improve access to the extensive data it holds. This includes offering cost-free access to public sector bodies, as well as exploring datasets pertaining to significant land holdings and properties owned by commercial entities. The review aims to identify optimal methods to support those in need of, and who would benefit from, improved access to this information while simultaneously mitigating associated risks.

Supporting Informed Decision-Making in Land Use

Baroness Taylor, the Minister for Housing and Local Government, emphasised the importance of HM Land Registry’s information in enabling more informed decision-making regarding land utilisation for housing and infrastructure development. The proposed consultation is designed to enhance access to vital datasets that would enable housebuilders, businesses, and local communities to make better-informed choices. Proposed changes to the fee structure aim to reduce unnecessary delays in accessing these services.

Commitment to Enhanced Customer Experience

Iain Banfield, Chief Executive of HM Land Registry, affirmed the organisation’s commitment to simplifying service delivery. He highlighted the need to balance the diverse requirements of the thousands of individuals and organisations utilising HM Land Registry’s services. The consultations present an opportunity to significantly improve customer engagement, and the feedback received will be instrumental in refining these proposals.

Balancing Transparency with Privacy Considerations

The proposals strive to balance the advantages of increased transparency against potential privacy concerns and the financial implications for HM Land Registry. Access levels will be tailored according to the user’s identity and purpose for accessing the information, with appropriate safeguards applied in each case. This structured approach allows for broad public access to mappable datasets detailing land ownership across England and Wales, while restricting access to sensitive residential title information.

Consultation Period and Stakeholder Engagement

These consultations will remain open from 27 October to 22 December 2026, with a comprehensive response to each consultation anticipated shortly thereafter. HM Land Registry is eager to receive input from a diverse array of stakeholders and will proactively reach out to key participants.
